Welcome to KeysBattle! These Terms of Service ("Terms") govern your access to and use of KeysBattle's website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Acceptance of Terms

By creating an account, accessing, or using KeysBattle, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Service Description

KeysBattle is an interactive piano learning platform that combines gaming elements with music education. The Service provides:

  • • Interactive gameplay with MIDI keyboard or computer keyboard support
  • • Multiple game modes: Listening, Learn, Practice, and Arcade
  • • Score tracking, leaderboards, and performance statistics
  • • Access to a library of public domain and user-uploaded musical content
  • • Social features including friends, favorites, and leaderboards
  • • Ability to upload and practice with custom MIDI files (subject to restrictions)

4. User Accounts

Registration

To access certain features, you must create an account. You agree to:

  • • Be responsible for all activities under your account

Account Security

5. User Conduct and Acceptable Use

You retain all ownership rights to content you upload ("User Content"). However, by uploading content, you grant KeysBattle a worldwide, non-exclusive, royalty-free license to:

  • • Use, reproduce, and display your User Content
  • • Modify or adapt your content for technical requirements
  • • Distribute your content through the Service
  • • Sublicense these rights to service providers

This license continues even if you stop using the Service, but you may delete your content at any time.

Content Responsibility

You are solely responsible for all User Content you upload. You represent and warrant that:

KeysBattle and its original content, features, and functionality are owned by KeysBattle and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

Restrictions

KeysBattle offers free and premium subscription plans. Premium subscriptions provide additional features and are billed on a recurring basis (monthly or annually).

Payment Terms

By subscribing to a premium plan, you agree to:

  • • Automatic renewal unless you cancel

Cancellation and Refunds

You may cancel your subscription at any time through the customer portal. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law.

Free Trials

If you sign up for a free trial, you will be automatically charged when the trial ends unless you cancel before the trial period expires.

9. Disclaimers and Limitation of Liability

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantees

We do not warrant that:

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEYSBATTLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM:

  • ✗ Your access to or use of (or inability to use) the Service
  • ✗ Conduct or content of other users
  • ✗ Unauthorized access to your account
  • ✗ Service interruptions or bugs

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, OR €100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless KeysBattle, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KeysBattle regarding the Service.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
